1. Acceptance of Terms
By accessing or using Jay Hind Medical Stores (the "Website"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
We operate as a licensed retail pharmacy in Gujarat, India, and these terms are governed by the laws of India.
2. Prescription Requirement (MANDATORY)
No Prescription, No Sale Policy
In compliance with the Drugs and Cosmetics Act, 1940 and Rules, 1945, Jay Hind Medical Stores will NOT dispense any medication categorized under Schedule H, H1, or X without a valid, original prescription from a Registered Medical Practitioner (RMP).
- Uploaded prescriptions must be clear, legible, and include the RMP's registration number, signature, and date.
- We reserve the right to verify prescriptions with the prescribing doctor.
- Any attempt to upload fraudulent prescriptions will lead to immediate account termination and reporting to appropriate authorities.
3. Eligibility and Account
- You must be at least 18 years of age to create an account and place orders.
- You are responsible for maintaining the confidentiality of your account credentials.
- All information provided must be accurate and up-to-date.
4. Pricing and Payments
- Prices for medicines are inclusive of GST as per Indian laws.
- While we strive for accuracy, price variations may occur based on manufacturer updates or batch numbers.
- Final invoice amount will be confirmed after our pharmacist reviews your prescription and order.
5. Delivery Policy
Deliveries are currently limited to specified regions in Gujarat. Delivery timelines are estimates and may vary due to weather, traffic, or stock availability. We do not ship scheduled drugs outside of our authorized licensed area.
6. Returns, Refunds & Cancellations
Given the sensitive nature of pharmaceutical products:
- Cancellations: Orders can only be cancelled before they are dispatched.
- Returns: We only accept returns if the medicine is damaged, near expiry, or the incorrect product was delivered. Returns must be initiated within 48 hours of delivery.
- No Returns for Open Packs: Medicines with broken seals or opened packaging will not be accepted for return under any circumstances.
7. Limitation of Liability
Jay Hind Medical Stores is a facilitator for the sale of medicines. We are not liable for any side effects, adverse reactions, or misuse of medication. Users must follow the prescribing doctor's instructions strictly.
8. Governing Law & Jurisdiction
These terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.
